3.1 Vom Nutzer bereitgestellte Daten
- Kontaktformular: Name, E-Mail-Adresse, Telefon (optional), Nachricht.
- WhatsApp-Kommunikation: Bei Klick auf den WhatsApp-Link wird eine vorausgefüllte Nachricht mit einer Tracking-Referenz generiert. Die über WhatsApp geteilten Daten unterliegen der Datenschutzrichtlinie von WhatsApp LLC / Meta.
- Mandantenbeziehung: Im Rahmen eines Mandatsverhältnisses: vollständiger Name, Ausweisnummer (DNI/NIE/Reisepass), Wohnsitz, Steueridentifikationsnummer, wirtschaftliche und finanzielle Daten, die für die Rechtsberatung erforderlich sind.

7. Empfänger der Daten
Wir verkaufen oder vermieten keine personenbezogenen Daten an Dritte. Daten können weitergegeben werden an:
- Google Ireland Ltd. (Analyse) — nur mit ausdrücklicher Einwilligung, gestützt auf das EU-US Data Privacy Framework.
- Hosting-Anbieter: Die Website wird auf Servern in der Europäischen Union gehostet.

8. Speicherdauer
- Anfragen (Formular, WhatsApp): 2 Jahre ab dem letzten Kontakt.
- Mandantendaten: Während der Dauer der Geschäftsbeziehung und nach deren Beendigung für die Dauer der gesetzlichen Verjährungsfristen (in der Regel 6 Jahre für steuerliche und buchhalterische Unterlagen nach spanischem Recht).
- Analyse-Cookies (GA4): 14 Monate (Google Analytics).
- Cookie aw_ref (Tracking-Referenz): 30 Tage.
- Cookie-Präferenz (aw_cookie_consent): 365 Tage.
- Kommerzielle Kommunikation: Bis zum Widerruf der Einwilligung durch den Nutzer.
Nach Ablauf der Aufbewahrungsfristen werden die Daten ordnungsgemäß gesperrt und nur für die gesetzlich vorgeschriebenen Zwecke aufbewahrt, bevor sie endgültig gelöscht werden.

3.3 Referencia de seguimiento (Cookie aw_ref)
Al visitar nuestro sitio, se asigna un código de referencia único (formato: AW-AAAAMMDD-XXXX) almacenado en una cookie técnica (aw_ref, 30 días) y en sessionStorage. Esta cookie es necesaria para:
- Atribuir consultas de WhatsApp a sesiones web específicas.
- Proporcionar al usuario un código de referencia que puede usar al comunicarse con nosotros.
- Mejorar la continuidad del servicio entre la web y WhatsApp.
Este código no contiene datos personales — es un identificador aleatorio. Base legal: interés legítimo (Art. 6.1.f RGPD).
4. Finalidades del Tratamiento
- Gestión de consultas: responder a solicitudes de información sobre nuestros servicios de asesoría jurídica inmobiliaria.
- Prestación del servicio: mostrar inmuebles disponibles, calculadora de honorarios, orientación jurídica.
- Análisis web: comprender el uso del sitio para mejorarlo (requiere consentimiento).
- Cumplimiento legal: atender obligaciones fiscales, contables y de prevención de blanqueo de capitales.

5. Google Analytics 4 (GA4)

7. Destinatarios de los Datos
No vendemos ni alquilamos datos personales a terceros. Los datos pueden ser compartidos con:
- Google Ireland Ltd. (analítica) — solo con consentimiento explícito, bajo el EU-US Data Privacy Framework.
- Proveedores de hosting: el sitio está alojado en servidores ubicados en la Unión Europea.
- Autoridades competentes: en cumplimiento de obligaciones legales (AEAT, AEPD, etc.).
- Notarios, Registros de la Propiedad, Bancos: solo en el marco de un encargo profesional y en la medida necesaria para la prestación del servicio jurídico.
8. Conservación de Datos
- Consultas (formulario, WhatsApp): 2 años desde el último contacto.
- Datos de clientes: durante la vigencia de la relación comercial y, una vez finalizada esta, durante el plazo de prescripción legal (generalmente 6 años para documentación fiscal y contable según la legislación española).
- Cookies de análisis (GA4): 14 meses (Google Analytics).
- Cookie aw_ref (referencia de seguimiento): 30 días.
- Preferencia de cookies (aw_cookie_consent): 365 días.
- Comunicaciones comerciales: hasta que el usuario revoque el consentimiento prestado.
Transcurridos los plazos de conservación, los datos serán debidamente bloqueados y conservados únicamente para los fines legalmente establecidos antes de su eliminación definitiva.
9. Derechos del Interesado
De acuerdo con el RGPD y la LOPDGDD, usted tiene derecho a:
- Acceso (Art. 15 RGPD): conocer qué datos personales tratamos sobre usted.
- Rectificación (Art. 16 RGPD): corregir datos inexactos o incompletos.
- Supresión (Art. 17 RGPD): solicitar la eliminación de sus datos ("derecho al olvido"), siempre que no existan obligaciones legales de conservación.
- Limitación del tratamiento (Art. 18 RGPD): restringir el tratamiento de sus datos en determinadas circunstancias.
- Portabilidad (Art. 20 RGPD): recibir sus datos en formato estructurado y transferirlos a otro responsable.
- Oposición (Art. 21 RGPD): oponerse al tratamiento basado en interés legítimo, incluida la elaboración de perfiles.
- Retirada del consentimiento (Art. 7.3 RGPD): en cualquier momento para los tratamientos basados en consentimiento.

10. Medidas de Seguridad

- Acceso restringido a los datos mediante autenticación.
- Anonimización de direcciones IP en herramientas de análisis.
- Actualizaciones y auditorías de seguridad periódicas.
- Políticas de seguridad implementadas conforme al RGPD y la LOPDGDD.
11. Menores de Edad
Nuestros servicios de asesoría jurídica inmobiliaria no están dirigidos a menores de 18 años. No recopilamos conscientemente datos de menores. Solo podrán facilitar datos los mayores de 16 años a través de nuestro sitio web.
